These Terms and Conditions govern all work carried out by Tom Harvey Contractors Ltd ("we", "us", "our"). By accepting a quote, signing an agreement, or instructing us to commence work, you agree to be bound by these terms.

These terms apply to all clients — residential, commercial, estate agents, and property managers — unless a separate written agreement has been signed.

Warranty

All completed works carry a 12-month workmanship warranty as standard, starting from the date of practical completion.
  • The warranty covers defects in workmanship only — it does not cover standard wear and tear, accidental damage, misuse, or damage caused by third parties.
  • The warranty is void if works are modified, interfered with, or repaired by another contractor without our prior written consent.
  • Any warranty claim must be reported in writing within the 12-month period. Claims reported after this period will not be considered.
  • Materials supplied by the client are excluded from our warranty. We accept no liability for material failure where items were not sourced by us.
  • Where materials are supplied by us, manufacturer warranties may apply in addition to our workmanship warranty.

Payment Terms

All invoices are due upon receipt, unless otherwise agreed in writing prior to work commencing.

  • Business and estate agent clients are granted a 30-day payment period from invoice date, subject to prior agreement.
  • Late payments will accrue a 2% daily interest charge on the outstanding balance from the due date.
  • All prices are subject to VAT at 20% unless the client is VAT-exempt and has provided written evidence of this.
  • Invoices must be settled in full upon job completion. Delays beyond 5 days for quality-related reasons are not permitted unless formally disputed in writing.
  • If an invoice is disputed, only the specific disputed element may be withheld — not the full invoice amount.
  • For larger projects, interim payment milestones may be requested by us even if not explicitly stated in the original quote, unless a tiered payment schedule has been formally agreed.
  • We reserve the right to suspend works on any project where payment is outstanding.

Deposits

A deposit is required on all works valued at £1,000 or above, unless otherwise agreed in writing.
  • Deposit amounts will be stated in the quote or agreement. Typical deposits range from 25–50% of the total project value.
  • Work will not be scheduled or commenced until the deposit has been received and cleared.
  • Deposits are non-refundable where work has already been mobilised, materials ordered, or a start date allocated, unless the cancellation is made with at least 5 working days' notice.
  • For smaller jobs under £1,000, full payment may be requested upon completion unless agreed otherwise.

Recall Policy

We stand behind the quality of our work. Clients have a 3-day recall period after job completion to raise any concerns or request minor adjustments to completed works.

  • Recall requests must be submitted in writing (email or WhatsApp) within 3 days of practical completion.
  • Requests made after the 3-day period may be treated as a new instruction and charged accordingly.
  • Recall visits are for genuine snagging items only — requests for additional works outside the original scope will be quoted separately.
  • We will attend within a reasonable timeframe, typically within 5 working days of a recall being raised.

Workplace Conduct

We are committed to providing our team with a safe, respectful working environment on every site.

  • Tom Harvey Contractors Ltd reserves the right to withdraw from any property where staff are subjected to verbal abuse, harassment, intimidation, or physical mistreatment.
  • In such cases, any deposit paid will not be refunded, and any work completed to that point will be invoiced immediately and must be paid within 7 days.
  • Clients must ensure the property is safe, accessible, and free from hazards before work commences.
  • Any health and safety concerns identified on site must be resolved before our team proceeds with work.
  • The client is responsible for informing us of known hazards including asbestos, lead paint, electrical issues, or structural concerns prior to our arrival.
  • Children and pets must be kept away from active work areas for their safety and to allow our team to work efficiently.

Materials & Surcharges

All materials sourced and supplied by Tom Harvey Contractors Ltd will comply with UK regulatory standards and be of mid-range quality or above, unless a specific product has been agreed with the client.

  • A 20% handling and procurement surcharge applies to all materials we supply, covering sourcing, delivery, management, and storage.
  • We reserve the right to refuse client-supplied materials that do not meet our quality standards, or that we are unfamiliar with and unable to guarantee.
  • If client-supplied materials are defective or unsuitable, we accept no liability for the resulting finish or any remedial works required.
  • Any additional materials required beyond the original estimate will be agreed with the client before purchase where possible. In urgent situations, materials may be purchased without prior approval and charged accordingly.
  • All leftover materials purchased by us remain our property unless otherwise agreed in writing.
  • Specialist or premium products requested by the client will be priced accordingly and may require an upfront materials payment.

Site Facilities

  • Our team has the right to use bathroom and water facilities at any property where work is being carried out, unless the client has made alternative arrangements.
  • Electricity and water supply must be available and operational throughout the duration of works — these are essential for completing the job.
  • Where possible, clients should provide secure storage for tools, materials, and equipment to ensure continuity between working days.
  • If adequate facilities are not available and this results in delays or additional costs, these will be passed on to the client.

Cancellations & Project Delays

  • Cancellations made within 48 hours of the agreed start date may be subject to a cancellation fee of up to 25% of the quoted project value, or the deposit amount — whichever is greater.
  • We are not liable for delays caused by unforeseen circumstances including extreme weather, supply chain disruptions, third-party contractor delays, or events beyond our reasonable control.
  • If works are halted due to issues caused by the client — including lack of access, non-payment, or unsafe conditions — rescheduling fees may apply, and any associated costs will be invoiced.
  • Should we need to cancel or reschedule due to circumstances on our side, we will provide as much notice as possible and will not charge for the rescheduled start.

Timeline & Completion

Any timeline provided during the quoting process or upon instruction is a general estimate only and does not constitute a guaranteed completion date.

  • Projects may take longer than anticipated due to unforeseen site conditions, additional works discovered during the job, or supply delays.
  • Tom Harvey Contractors Ltd will not be held liable for hotel costs, rental costs, loss of income, or any other financial losses or inconvenience arising from project delays.
  • We will always communicate proactively if a timeline is likely to change and will work with the client to find a suitable resolution.
  • Where a fixed completion date is essential, this must be agreed in writing before works commence and may affect pricing.

Liability & Insurance

Tom Harvey Contractors Ltd holds public liability insurance. A copy of our certificate is available upon request.
  • We are not responsible for pre-existing damage or structural issues uncovered or discovered during the course of works.
  • We are not liable for accidental damage to personal property, fixtures, or fittings that have not been moved or adequately protected by the client or by us as agreed.
  • Any changes to the agreed scope of work must be documented in writing and may result in additional charges.
  • Our total liability to the client shall not exceed the value of the contracted works.
  • We are not liable for consequential losses, loss of profit, loss of use, or any indirect losses arising from the performance or non-performance of our services.
  • Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

Waste Disposal

  • We will remove all job-related waste and debris at the end of each working day and upon project completion, unless otherwise agreed.
  • Large-scale waste removal — including old furniture, appliances, or excessive pre-existing debris — is the client's responsibility unless specifically included in the scope of work.
  • Hazardous waste disposal (including asbestos, chemicals, or contaminated materials) is not included in our standard service and must be arranged and paid for separately.
  • We comply with UK waste disposal regulations and do not illegally dump waste at any time.

Access & Working Hours

The client must provide reasonable and prompt access to the property during agreed working hours. Failure to do so may result in delay charges.

  • Standard working hours are Monday to Friday, 8:00am – 5:30pm, unless otherwise agreed in writing.
  • Saturday working is available by prior arrangement and may be subject to a weekend rate surcharge.
  • If access is restricted or delayed and results in our team being unable to work, a daily call-out charge of £95 + VAT (minimum) may apply.
  • For properties managed by estate agents or letting agents, the client is responsible for ensuring all access arrangements are in place before our team arrives on site.

Subcontractors

  • Tom Harvey Contractors Ltd may use vetted third-party contractors or subcontractors to carry out specific elements of work — including specialist electrical, plumbing, or structural tasks.
  • All subcontractors working under our instruction are covered by our public liability insurance or their own equivalent policy.
  • We handle all communication, coordination, and quality control with subcontractors. Clients should not issue instructions directly to subcontractors on site.
  • We are not responsible for delays or defects caused solely by subcontractors but will take reasonable steps to resolve any issues efficiently on the client's behalf.

Data Protection

Tom Harvey Contractors Ltd complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

  • Personal data collected from clients is used solely for the purpose of delivering contracted services, sending invoices, and business communication.
  • We do not sell, rent, or share personal data with third parties without consent, except where required to fulfil contracted work (e.g. sharing an address with a subcontractor).
  • Clients have the right to access, correct, or request deletion of their personal data at any time. Requests should be directed to info@tomharvey.co.uk.
  • Data is stored securely and only retained for as long as necessary for legal and business purposes.

Complaints Procedure

We take quality seriously. If you are unhappy with any aspect of our service, we want to know.

  • All complaints must be submitted in writing to info@tomharvey.co.uk with a clear description of the issue and any supporting photographs.
  • We will acknowledge your complaint within 2 working days and aim to provide a full response within 7 working days.
  • Where a genuine error has occurred, we will return to assess and rectify the issue at no additional cost, within the warranty period.
  • We ask that complaints are raised directly with us before any third-party review platforms are used, so we have the opportunity to resolve the issue first.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

  • Any disputes arising from these terms or any agreement between the client and Tom Harvey Contractors Ltd shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • We reserve the right to update these Terms and Conditions at any time. The version in force at the time of instruction will apply.
  • If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force.
  • These terms form the entire agreement between the parties and supersede all prior communications, representations, or agreements relating to the subject matter.
